Thailand marriage visa: Non-O and the annual extension based on marriage
How Thailand’s marriage-based Non-O works in 2026: financial tests, documents, same-sex spouses, annual extensions, work permits and genuine-marriage checks.

Where to start
Thailand does not issue a special document formally called a “wife visa” or “husband visa.” For most foreign spouses of Thai citizens, the practical route is a Non-Immigrant O family status followed by an extension of stay based on marriage, normally granted for up to one year at a time. The visa that gets you into the Non-O category and the later one-year extension are separate decisions, often made by different authorities.
That distinction matters because a Thai embassy abroad may publish a family-visa checklist that is not identical to the Immigration Bureau criteria used for the annual extension in Thailand. A mission can ask for bank statements showing THB 400,000 or monthly income of THB 40,000 when it processes the initial Non-O. The current domestic extension order, however, is more nuanced: its financial wording is not identical for every spouse configuration.
Marriage is also tested as a real relationship, not merely a certificate. Immigration Order No. 12/2568 requires the spouses to be related both de jure and de facto. In ordinary applications that can translate into current family photographs, address evidence, the Thai spouse’s records, an interview and, where the office considers it necessary, a home visit. A sham marriage is therefore both a legal risk and a poor immigration strategy.
Thailand’s marriage-equality law took effect on 23 January 2025, and the current immigration framework expressly accommodates same-sex and gender-diverse spouses. BOI’s LTR programme separately confirms that a legally married same-sex spouse can qualify as a dependent. The figures and procedural references on this page were checked on 31 August 2026, but immigration and consular practice is document-sensitive: re-check the exact office or mission before moving money or filing.
In short
- A Thailand marriage visa is usually a Non-Immigrant O family route plus a marriage-based extension of stay, not a separate visa called a spouse visa.
- For the annual extension, the marriage must be legally valid and genuine in practice; officers can ask for photographs, interviews and address evidence.

- Same-sex marriages have been legally recognised in Thailand since 23 January 2025 and are expressly accommodated in the current family-immigration framework.
- Marriage-based status is not a work permit. Employment authorisation is a separate labour-law process.
- Once you hold a long extension, 90-day reporting and travel planning still matter; check re-entry permission before leaving Thailand.
What fits you
The direct family route. Expect annual evidence of the marriage, Thai-spouse documents and the financial test that actually applies to your case.
DTV may fit better when the purpose is foreign remote work rather than the marriage itself. The published financial evidence threshold is at least THB 500,000; confirm the current mission checklist.
Published benchmarks are THB 800,000 in funds or THB 65,000 monthly income. It avoids proving a marriage, but it is a non-working retirement basis.
Bronze is THB 650,000 for five years as of 31 August 2026. The membership provides long-stay visa status, not employment permission.
A marriage extension can support lawful residence, but it does not replace the work-permit process. Build the employment documentation around the actual job.

Who can use the family route
A marriage certificate starts the case; it does not finish it. For the annual family extension, the foreign spouse needs the relevant non-immigrant status and a legally recognised relationship with a Thai citizen. Immigration Order No. 12/2568 says the spouses must be related both de jure and de facto, which is why officers look for a household that makes sense beyond the registry entry.
The financial rule deserves careful reading. In an opposite-sex marriage, the current order expressly attaches the THB 40,000 average monthly-income test or THB 400,000 Thai-bank test to a foreign husband married to a Thai woman; the bank option requires the prescribed two-month holding period before the application. The same paragraph is not mirrored as a THB 40,000/400,000 test for a foreign wife of a Thai husband. That does not mean an initial embassy application will never ask a foreign wife for funds: overseas Non-O checklists can impose their own evidence requirements, so always separate the visa stage from the domestic extension stage.
Same-sex and gender-diverse spouses are now covered expressly. Thailand began registering marriages on an equal basis on 23 January 2025, and the current immigration order contains a specific financial provision under which one spouse or both together can meet the applicable income or savings test. BOI makes the same legal distinction in its LTR dependent rules: a legally married same-sex spouse is accepted, while an unmarried partnership is not.
A foreign marriage may need additional Thai paperwork before it becomes usable in an in-country immigration file. Published visa-change materials refer to the foreign marriage certificate together with Thai family-status registration, commonly Kor.Ror.22, plus the Thai spouse’s identity and house-registration records. Translation, legalisation and certification depend on where the marriage document was issued and on the procedure being used. Treat the local immigration checklist as the final document-control step before filing, not as something to reconstruct from an old forum post.

Step by step
Establish the legal marriage
Use Thai marriage records if the marriage was registered in Thailand. For a foreign marriage, confirm translation, legalisation and Thai family-status registration requirements before you build the visa file.
Enter the Non-O route
Apply through the Thai mission responsible for your location, or use the in-country visa or status-change process where your current admission and Order No. 14/2568 allow it. Do not assume the same deadline or document set applies to both routes.
Build the extension evidence
Identify the correct financial criterion, allow enough time for any required Thai-bank history, and collect current proof of the household and relationship.
File the annual extension
Apply at the immigration office responsible for your residence. Both spouses should be ready to attend, answer questions and provide additional evidence if requested.
Complete any verification
Interviews, family photographs and residence checks are genuine enforcement tools. A 2026 Immigration Bureau field report documented a home visit in a family-based Non-O case, so do not build an application around a paper-only relationship.
Maintain the status
Track 90-day reporting and the next extension date. Before international travel, check whether you need a re-entry permit to preserve the current permission to stay.

There is no honest nationwide price band for this layer. Cost changes with the issuing country, language, legalisation route and number of documents; obtain a written quote before ordering.
Schemes and red flags
“A paper marriage is enough for the visa”
A broker sells a marriage with no real family life and treats the certificate as the whole annual-extension case.
There is no credible shared address, family evidence or willingness to attend an interview or residence check.
Do not submit a sham relationship or false evidence. The current rule requires a marriage that exists both legally and in fact, and Immigration Bureau uses real verification measures.
“Our contact guarantees immigration approval”
The service is sold as a guaranteed result rather than transparent preparation of a file that meets published criteria.
No current checklist, no official receipts and no clear explanation of which legal criterion you satisfy.
Pay for defined document or representation work, not a promise to control the officer’s decision. Approval remains with the competent authority.
“We can park THB 400,000 in the account on filing day”
Temporary funds are deposited immediately before the application to create a snapshot balance with no required history.
The money arrives at the last moment even though the applicable rule requires a prior holding period.
Identify the correct financial criterion early. For a foreign husband of a Thai wife using the bank route, Order No. 12/2568 requires the funds for the prescribed two months before filing.
“One document pack works at every embassy and immigration office”
An old template mixes the initial overseas Non-O application with the domestic annual extension and ignores the handling authority.
The adviser cannot tell you which mission or immigration office will decide each stage or when the checklist was updated.
Treat the visa and extension as separate stages and use the current checklist of the actual authority handling each one.
“Marriage automatically lets you work in Thailand”
A family-based stay is marketed as if it were employment authorisation.
No one is discussing the Department of Employment, the employer documents or a separate work permit.
Keep immigration status and employment permission separate. Obtain the work authorisation required for the actual job.
The right to work
Marriage-based Non-O status is not a work permit. Thailand’s Ministry of Labour places foreigners with lawful temporary non-immigrant stay among those who can apply for work permission, but the labour authorisation is a separate legal step tied to the job and the applicable employment rules.
That makes marriage status useful as a residence foundation for some families, not a shortcut around employment law. If you will work for a Thai employer, make sure the employer and Department of Employment process the work authorisation and confirm when lawful work may begin. Labour procedures were updated again in 2026, so use the current Department of Employment requirements rather than an old visa-agent checklist.

The THB 400,000 figure gets repeated so often that people start treating it as the whole marriage-visa system. I would first identify which rule actually applies to the couple and whether we are talking about an embassy Non-O application or the annual extension in Thailand. Then I want the household evidence to look ordinary and real: the same address, current photographs and two spouses who can answer straightforward questions without rehearsing a story. If bank funds are the chosen route, I would move them through a traceable channel early enough to satisfy the actual holding period, not borrow a balance for filing day. Before any large transfer, I would still re-check the handling office’s current requirement because immigration paperwork is not the place to discover that a familiar rule was applied to the wrong stage.
