Consumer Protection in Thailand: Where Foreigners Can Complain
Quick — 10-second read
- In short
- Start by preserving evidence and telling the business in writing what happened and what resolution you want. Then match the channel to the problem: OCPB for an ordinary consumer dispute, OCPB FastTrack if the participating business is offered in the system, 1212 ETDA for relevant online issues, and the police where there are signs of a possible crime or an immediate threat.
- Who it matters to
- For a foreign resident or visitor who has a dispute over goods or services in Thailand and is looking for a practical complaint route.
- Next step
- Save the receipt or payment proof, order number, messages, photos and the terms shown at purchase, build a short dated timeline, then choose the official channel that fits the dispute.
This is a guide, not legal, tax or investment advice.
First classify the problem before choosing a complaint channel
Two people can both say, “I paid and did not get my money back,” yet need different complaint routes. One may have bought an air conditioner from a known retailer and received a model that does not match the agreed specification. Another may have paid an unfamiliar website that vanished shortly afterwards, with the seller no longer responding. The immediate loss feels similar; the nature of the problem is not.
A disagreement over product quality, a promised service, a refund, advertising claims or contract performance usually belongs first in the consumer-protection track. Put the facts in writing before escalating: what was purchased, when it was paid for, what the business represented, what actually happened, and what remedy you are asking for. A written record is more useful than a sequence of angry calls because an official complaint needs a coherent account of the dispute.
An online transaction carries a second layer of evidence. The website address, marketplace profile, order number, payment confirmation, product page, chat history and screenshots can matter as much as the receipt. ETDA's 1212 channel is designed for issues involving online trading, illegal websites and cyber threats. In a case that is both a consumer dispute and an online-platform problem, 1212 ETDA can sit alongside OCPB rather than automatically replacing it.
Police involvement belongs to a different branch. A routine disagreement about quality or a refund does not become a police matter simply because the business is being difficult. The picture changes if there are signs of a possible crime, theft, threats, a deliberately deceptive setup or an immediate safety risk. Describe what happened and the evidence you have; avoid turning suspicion into a legal conclusion before the facts are assessed.
Which complaint channel fits your situation
Document the request and evidence first; do not promise a specific outcome.
Explain that FastTrack is offered only for participating businesses; the 14-day period is a handling SLA, not a refund guarantee.
Show when the digital-complaint channel complements rather than replaces a consumer complaint.
Do not frame the police as the default way to force a refund in an ordinary civil consumer dispute.
OCPB: the main route for disputes with shops and service providers
OCPB is Thailand's Office of the Consumer Protection Board. For an ordinary dispute with a retailer or service provider, it is the central official route once direct contact with the business has not produced a workable resolution. Complaints can be filed through complaint.ocpb.go.th, and OCPB lists 1166 as its consumer hotline. Its official information also points to Provincial Hall channels outside Bangkok.
A useful complaint is factual before it is legalistic. The person reading it should be able to identify the business, the purchase or service, the gap between what was promised and what happened, and the remedy being requested. A long account of poor customer service can be emotionally accurate but still leave the core dispute unclear if there is no order reference, payment proof or stated resolution.
For goods, the practical evidence set may include the receipt or payment confirmation, order number, the product description or advertisement shown at the time of purchase, warranty terms, photos and the message history with the seller. For a service, the contract or booking, the agreed scope, payment record, correspondence and evidence of the actual outcome are usually more useful than broad accusations. A short dated chronology helps connect those documents.
OCPB publishes an English section for foreign consumers. It describes complaint channels, including online filing, hotline 1166 and filing through Provincial Hall or the Damrongdhama Center in other provinces. The same official material outlines a complaint-handling process that includes mediation. Foreign nationality therefore does not, by itself, remove a consumer dispute from the OCPB route.
Do not attach an invented deadline to the ordinary OCPB process or treat filing as a promise of compensation. The handling path can vary with the facts, evidence and the response from the business. The value of the process is that the complaint enters an official system, can be followed, and may move into further review or mediation if the first stage does not resolve the issue.
OCPB FastTrack: when a complaint goes directly to the business
FastTrack is not a separate authority and it is not a “14-day consumer court.” It is an accelerated route inside the OCPB complaint system. A consumer files through the normal process, the system checks whether the named business participates in FastTrack, and only then can the FastTrack option be offered. A company that is not part of the scheme cannot simply be forced into that route by the complainant.
Consent is part of the flow. OCPB's description says the system asks the complainant whether to use FastTrack. If the consumer agrees, the complaint goes through an initial OCPB check and is then sent directly to the participating business through the platform. The business receives the complaint details and attachments, while the consumer can follow the status.
The 14-day figure needs careful wording. OCPB sets a 14-day SLA for the participating business after it receives the complaint. That is a handling window within FastTrack, not a promise that a refund will reach the consumer within 14 days, that compensation will be paid, or that every dispute will be closed by then. The result still depends on the facts and what resolution the parties can reach.
An unresolved FastTrack case does not fall into a void. OCPB states that if the business cannot settle or resolve the matter within the SLA, the complaint returns to the ordinary OCPB process for further handling, possible mediation or referral as appropriate. FastTrack is best understood as a shorter route to the participating business, not a separate guarantee of success.
Online shopping, suspected fraud and police: where the line is
Online disputes often leave more useful evidence than the buyer realises at the time. A product page can disappear, a seller can delete messages, and website terms can change. Saving the URL, screenshots, seller profile, order reference, payment confirmation and chat history while they are still available can preserve the story of the transaction even if the storefront later changes.
ETDA, the Electronic Transactions Development Agency, operates the Online Fraud and Complaint Center 1212. Its official description covers problems involving online trading, illegal websites and cyber threats, with 1212 as a contact channel. That does not turn 1212 into the only destination for every e-commerce disagreement. If the core issue is still a consumer dispute — for example, an item arrives but does not match the listing — OCPB may remain relevant, while 1212 becomes useful where the digital element is material to the problem.
Consider two online orders. In the first, a buyer receives the wrong phone model from an identifiable seller and the argument is over replacement or refund terms. In the second, a website takes payment, uses questionable identifying details and disappears, or the buyer sees signs that an account or payment data may have been compromised. Both began as online shopping, but the second raises a different set of concerns and may call for a different escalation path.
The same distinction matters with the police. A business refusing a refund does not, by itself, establish fraud. Threats, theft, violence, fabricated circumstances or other signs of a possible crime change the situation. Tourist Police publishes 1155 as an official contact channel for foreigners and tourists. The contact number should not be presented as proof that Tourist Police mediates ordinary refund disputes or guarantees recovery of money.
If someone is in immediate danger, personal safety comes before perfect categorisation. Otherwise, keep the description factual: the website stopped responding after payment, the account details did not match the order information, or threats were received. That preserves the evidence without turning suspicion into a legal verdict before the relevant authority has assessed it.
If the dispute remains unresolved: mediation, escalation and legal help
A complaint does not end when the form is submitted. OCPB's system allows the case status to be followed, and its information for foreign consumers describes further handling stages that include mediation. FastTrack has an explicit fallback as well: if the participating business does not settle or resolve the matter within the applicable SLA, the case returns to the ordinary OCPB process for further action.
Mediation can be useful where the parties disagree about performance, quality, facts or the remedy but still have room to reach an agreement. It does not mean the authority will automatically adopt the consumer's version. The business may produce its own contract terms, records or evidence, which is why a coherent file remains important after the first complaint is lodged.
Some disputes move beyond a routine consumer complaint quickly. A significant amount of money, a complex contract, real estate, bodily injury, several linked companies or a situation that may require court proceedings are all reasons to consider specialist legal advice. Universal claims about limitation periods, compensation or likely court outcomes are unsafe here because the answer depends on the specific facts and the law that applies.
This article is a route map for initial orientation, not an individual legal opinion. Before filing, confirm the current forms, contacts and procedures on the relevant official OCPB, ETDA or police channel. Where the consequences are substantial, a lawyer will get more value from the underlying contract, payment records, correspondence, timeline and complaint history than from a broad summary of the dispute.

Expert view

The weakest complaints usually start with emotion and only later try to reconstruct the paperwork. I prefer to reduce the dispute to a clean file: payment, the terms that were shown, the message history, a short timeline and one clear requested remedy. That makes it easier for the business to answer the actual issue and for an authority to see the case without guessing. Once the dispute involves a substantial amount or moves beyond an ordinary refund argument, it is worth treating the legal classification as a separate question without assuming the complaint channel will solve everything.
