Thai SEC’s June proposal opened funds to GHB savings certificates

Event date

The June proposal covered retail mutual funds, accredited investor funds and provident funds. The SEC wanted to bring GHB savings certificates into the regulatory category of “deposits or deposit-equivalent instruments”, giving fund managers another eligible asset for portfolio and liquidity management.

At the time, comparable savings certificates issued by the Government Savings Bank and the Bank for Agriculture and Agricultural Cooperatives were already covered by that category. GHB certificates were not, even though the regulator said their legal structure and return-payment features were similar.

The June consultation did not require funds to change portfolios

The first public consultation ran from 18 June to 18 July 2026. The Capital Market Supervisory Board had approved the proposal in principle, but the amendment was not yet an effective rule.

The SEC said the change could broaden investment choices while keeping the existing risk controls in place. Asset managers would still be subject to investment limits, diversification requirements and concentration controls such as single-entity and group limits.

Fund members and unitholders therefore need to separate the two. Eligibility gives a manager another permitted option; it does not mean every affected fund must buy GHB certificates or alter its allocation.

The proposal became effective in September

By September, the regulatory process had moved beyond consultation. On 17 September, the SEC announced final regulations adding GHB savings certificates to the deposit or deposit-equivalent category for retail mutual funds, accredited investor funds and provident funds.

The rules took effect on 16 September 2026. The SEC also confirmed that the existing requirements on investment limits, diversification, disclosure and concentration risk continue to apply. The June story therefore marks the start of the change, while the current position is that the investment option is now permitted under the final rules.
