Cambodia considers joint procedures for road accidents involving insured vehicles

Event date

The proposal addresses coordination between agencies

When an insured vehicle is involved in a road accident, the matter may require administrative records, an insurance claim and, in some cases, legal proceedings. Cambodia's Ministry of Justice, Ministry of Interior and Ministry of Economy and Finance are examining how their respective responsibilities should fit together.

The discussion took place at the Ministry of Interior on 14 October. DGCambodia reported the meeting the following day, citing a Ministry of Justice social media announcement. Its account describes a draft inter-ministerial instrument dealing with the sequence of case-handling steps and the transfer of matters to the relevant authorities when necessary.

The proposal is specifically framed around accidents involving vehicles with insurance cover. The available account does not reproduce the draft instrument, set out a final list of required documents or identify an adoption date. It is therefore too early to describe precisely how a future claims process would work.

Policyholders have no new claim deadline from this meeting

The potential benefit for drivers, insurers and businesses operating fleets is a clearer division of responsibilities after a collision. That could make it easier to understand which institution handles a particular stage of the case. Whether it will actually reduce delays depends on the wording and implementation of any adopted instrument.

As of 17 October, the reported development is a review of a draft, not the introduction of binding new rules. No deadline for submitting an insurance claim, compensation formula or mandatory payout timetable can be established from the meeting report. Nor should the proposal be interpreted as a new requirement for every vehicle in Cambodia to purchase insurance.

For a current accident or claim, the applicable law, the actual insurance policy and directions from the competent authorities remain the appropriate reference points. Fleet owners may also want to clarify internal responsibilities for notifying their insurer and preserving incident records, irrespective of what the ministries eventually adopt.
