Hua Hin property nominee probe widens after August raids

The August operation focused on 33 specific companies

Royal Thai Police said agencies had reviewed 3,808 registered companies in Prachuap Khiri Khan province before the Hua Hin operation. Of these, 1,568 had foreign shareholders, while the Department of Business Development identified 489 entities with characteristics that warranted checks for possible nominee shareholding.

Police then narrowed the enforcement action to 33 companies that investigators alleged were not conducting genuine business and may have been used to disguise foreign control of land. Authorities linked those companies to 39 land and property holdings covering 24 rai, 3 ngan and 42.8 square wah, with an estimated combined value of about 300 million baht. The police release described 33 cases involving 84 suspects — 39 Thai nationals and 45 foreigners — along with 15 search warrants and 45 arrest warrants for foreign nationals.

There was an immediate discrepancy in the arrest count. The Royal Thai Police release said 14 people were arrested on warrants that day, while The Nation and several other reports put the figure at 13. Because these were early operational figures, the safer conclusion is simply that more than a dozen people were detained while the investigation continued.

One part of the operation concerned six companies linked to a housing and pool-villa development in the Hua Hin area. Police said statements from foreign nationals and Thai shareholders supported their suspicion that some shareholdings were nominal rather than genuine. Those statements, seized records and electronic evidence are investigative material; they are not the same as a final court finding of guilt.

September screening goes well beyond the original raid

At a provincial meeting on 8 September, land authorities presented a wider review of juristic persons holding land across Prachuap Khiri Khan. The Provincial Commercial Office reported that 2,616 landholding entities had been reviewed province-wide and 780 were placed in risk groups for further examination. Within the Hua Hin land-office area, 1,849 entities were reviewed and 694 were selected for deeper scrutiny.

That 694 figure should not be combined with the 33 companies from the August cases. The August number refers to a defined enforcement action in which police had already opened cases and described suspected structures. The September figure is a broader screening population, and inclusion in it does not by itself establish that a company used nominees or broke the law.

Across the province, officials also reported 71 entities holding 92 plots that met the criteria cited under Sections 97 and 98 of the Land Code because of their foreign-shareholding structure and were therefore subject to a land-disposal process within the period set by the Land Department. The official update did not say how many of those 71 were in Hua Hin or connected to the August investigation.

Why this matters to a foreign buyer

The enforcement action does not mean that every Thai company with foreign participation is unlawful. The issue being examined is whether the Thai shareholders are genuine participants, whether the company has real business substance, and whether the corporate structure is being used merely to hold land for a foreign beneficiary.

For someone considering a house or villa in Hua Hin, the practical point is that company registration alone does not settle the legality of the ownership structure. The August cases and the September screening show authorities comparing corporate records with landholding and the actual roles of shareholders. A property can be attractive on its own merits while the structure proposed to control the land still creates a separate legal risk.
