Three Phuket accommodation businesses faced hotel-license enforcement in Karon and Rawai

Thailand’s Department of Provincial Administration said its central special-operations team investigated three accommodation businesses in Karon and Rawai after receiving information about unlicensed operators in Phuket. Officials said the properties were taking reservations through online booking channels and providing temporary stays in a manner comparable to hotels, while lacking valid hotel-business licences.

Reports on the operation say those responsible were arrested, records and other evidence were collected, and the matters were passed to investigators. That procedural status matters. An inspection and arrest are enforcement steps, not a final determination of guilt, and the sources reviewed for this article do not show a final judgment for the three Karon and Rawai cases.

Thailand’s Hotel Act B.E. 2547 (2004) defines a hotel broadly as commercial temporary accommodation for payment, but it excludes accommodation established solely for stays charged on a monthly basis or longer. That makes the operating model important: the law does not reduce every residential rental to the same category.

A 2023 ministerial regulation also provides a route for certain small accommodation businesses. Properties with no more than eight rooms and capacity for no more than 30 guests can fall outside the hotel definition only after the required notification, official inspection and written acknowledgement from the Hotel Registrar. Size alone does not create the exemption.

Rental-income assumptions need an operating-model check

For an owner or buyer, a projected nightly-rental return should be tested against the legal structure that produces it. The useful questions are whether the accommodation is operating under a hotel licence or a recognised non-hotel route, whether the building may be used in that way, and who is actually responsible for guest bookings and services.

The Karon and Rawai enforcement action is therefore not evidence that every short stay in Phuket is illegal. It does show why ownership of a condo or villa, an online listing and a management agreement are not, by themselves, proof that a hotel-style rental business has the permissions it needs.
