Law and taxes when buying property in Bali
The expensive mistake is looking for one number or one ‘safe structure’. First establish what is being acquired, who can transfer it, which payments are contemplated and what still needs to be checked at the actual address.
Where do you start when a deal mixes rights, contract terms and taxes?
Start neither with a yield promise nor with a cost table. Ask for the exact address and asset description, map the parties, then separate every amount: what it pays for, who receives it, on what basis and what must happen before the next transfer.

First separate the asset, right, contract and use
In a purchase discussion, these four layers quickly collapse into one word: ‘villa’. A villa describes what you can see. It does not answer which land or other legal framework sits beneath it, who holds it, what the agreement promises or whether the intended use is permitted at that address.
Indonesia’s basic agrarian law distinguishes land-right categories and treats registration as a legal baseline. Government Regulation No. 18 of 2021 separately sets a framework for a foreigner’s residence. That is a useful starting point, not a ready answer for a marketed asset.
For the first document folder, name the asset exactly as it will be described in the records, give its address and request the underlying right, current holder and role of every party.

Before reservation: build a money map, not a cost table
Request one schedule of every payment — not merely the headline price. Each line should state its basis, recipient, currency, date or trigger, the record you receive in return and the consequence if evidence is missing. If a line cannot be expressed that way, it is not yet clear enough to pay.
Separate price or price components from service fees, deposits and items described as tax or levy. ‘Included’ is not an answer: parties may agree a cost allocation, but contract wording does not replace verification of the legal basis and the actual liable party.
Do not transfer money on the strength of a brochure or an oral structure alone. Connect the payee to a contracting party and its authority; if roles diverge, request the documentary explanation before paying.

The contract matters, but it does not close the whole review
An agreement should answer at least four practical questions: what is transferred, who must act, when each stage occurs and what follows if performance fails or becomes impossible. For a future build, add one more: what exact result must be delivered and how the parties will assess conformity with the agreement.
For land transactions, the PPAT role is connected to deeds used as a basis for registration changes in land data. That does not mean one signed document proves every condition; it shows why authority chains and records should not be left to the last day.
If an agreement refers to renewal, rental, management, resale or construction, do not turn those words into assumptions. For each, request the mechanism, responsible party, time frame and consequence of failure.

Taxes: distinguish legal liability, contract allocation and calculation
Government Regulation No. 34 of 2016 addresses income tax on transfers of land and/or building rights and related sale-and-purchase binding agreements. Law No. 1 of 2022 governs central–regional financial relations, including regional taxes. These sources show that a transaction may involve different levels and different triggering events; they do not produce a safe universal estimate for every buyer.
That is why this page does not publish an ‘evergreen rate’ or assign one party as liable without the facts. A specialist needs the transfer type, parties and tax status, price and tax base, address, stage, document and contractual allocation. Local procedure can also depend on the territory where the asset sits.
A useful question for the seller or lawyer is: ‘For each line, what obligation is contemplated, who is liable by law, what have the parties agreed by contract and which document will evidence it?’

The address and intended use are a separate conversation
A purchase for personal residence, rental, hospitality use or later resale creates different questions. They cannot be closed by saying ‘people do this in the area’. You need current records and a review of the use you actually intend.
Bali’s provincial spatial-planning portal is useful for orienting yourself to documents and their status. The portal itself warns that digital information and maps do not replace official documents for legal, administrative or technical purposes.
That means the address should be checked before a major payment is scheduled, not afterwards. The right in an asset and the permitted use scenario are related but separate conclusions.

How to prepare a short, useful review brief
Instead of asking ‘is this project safe?’, give the reviewer one clear folder: address and description, offer or agreement, a map of parties and payees, every payment line, intended use and your status or objective. Ask for the response to separate what is confirmed, unverified and impossible to resolve without further records.
That produces a decision list rather than a sales summary: what can be resolved before reservation, what must be fixed in the agreement and where to stop until evidence appears.

Decision steps
- Fix the subject matter
Obtain the exact address, description and records to which the offer relates.
- Map parties and money
Put the right holder, signatory, payee and supporting records into one map.
- Separate each tax line
Request the basis, contemplated liable party, contractual allocation and supporting record.
- Check the address before a major payment
Compare the intended use with current planning and approval records.
FAQ
Should I choose the right structure or the asset first?
The two steps run together: a right structure only has meaning for a specific asset, address, purpose and parties. Fix those facts first, then test the framework.
If I am told taxes are included, can I stop asking?
No. Ask for a line-by-line breakdown: what is included, on what basis, who is liable by law, what the parties allocated by contract and how it will be evidenced.
Can a lawyer simply confirm that a deal is safe?
It is more useful to request verifiable conclusions on the actual records: what is confirmed, what depends on further documentation, which terms require change and what lies beyond the available facts.
Why is a national rule not enough for Bali?
A national rule sets a framework. The actual address, records, planning and approvals need separate review; a Bali digital map does not replace official documents.
What should I prepare before the first serious transaction discussion?
The address, offer or agreement, asset description, party and payment map, intended use and your non-negotiable risks. That is enough to make the discussion specific.
