Cambodia and Myanmar sign double taxation agreement

Event date

Cambodia's General Department of Taxation announced the agreement on 11 September. Agence Kampuchea Presse reported that it was one of four bilateral documents signed in Phnom Penh during meetings between the two governments.

The development is relevant to businesses and individuals whose income, payments or tax position spans Cambodia and Myanmar. For now, however, the practical tax treatment of those transactions remains governed by rules already in effect rather than by the newly signed treaty.

Treaty relief is not available simply because the agreement was signed

As of 21 September, the official material reviewed for this article does not provide an entry-into-force date. A 14 September tax update from DFDL likewise states that the agreement is not yet effective and that both countries must complete their respective legal procedures and exchange the required instruments or notifications before it can enter into force.

The full treaty text was also not available in the public material reviewed. That matters because specific outcomes can depend on detailed provisions covering particular income types, residency tests, documentation and the method used to relieve double taxation. It would be premature to import rates or conditions from Cambodia's other tax treaties and assume they apply here.

Until the Cambodia-Myanmar agreement becomes effective, taxpayers should not treat the signing as evidence that a reduced treaty rate or other treaty benefit can already be claimed.

The next useful milestone is the treaty text and effective date

Once in force, the agreement could become relevant to companies making cross-border payments and to individuals with taxable income connected to both countries. DFDL describes the treaty as establishing a framework for allocating taxing rights, administrative cooperation and information exchange between Cambodia and Myanmar.

The practical analysis can only be completed once the final text and effective date are public. At that point, taxpayers will be able to test the treaty against their actual income type, residence position and supporting documents instead of planning around assumptions.
