Cambodia and Myanmar sign a separate investment protection agreement
The investment agreement was one of four documents concluded during the visit, alongside a double-taxation agreement, an amendment on cultural cooperation and a memorandum on media and information cooperation. Cambodian and Myanmar official reporting both describe the investment pact as a separate instrument.
For a business considering cross-border investment, that distinction matters. A signed investment treaty may become relevant to the legal protection of qualifying investments, but it should not be regarded as an immediate change to company registration, licensing, tax or ownership rules.
The investment pact is separate from the tax treaty
The double-taxation agreement signed on the same day addresses a different legal problem. Its eventual rules on taxing rights or cross-border income cannot be assumed to form part of the investment protection agreement.
This matters for transaction planning because tax treatment and treaty protection may both affect the same project while operating through different legal instruments. The 11 September package therefore created two potentially important business agreements, not one combined regime.
For practical context, see Cambodia economy and finance. This development also connects with Cambodia and Myanmar sign double tax agreement.
Key treaty terms are still unavailable publicly
As of 22 September 2026, the accessible official announcements cited below do not provide the full investment treaty, an entry-into-force date, definitions of investor and investment, rules for pre-existing investments or a dispute-settlement mechanism. Those points cannot safely be filled in by borrowing language from Cambodia's or Myanmar's other investment treaties.
The practical consequence is straightforward: investors do not yet have a published basis for claiming that a particular corporate structure, asset or dispute falls within this new agreement. The signing confirms political and legal intent to create a bilateral framework, but the scope of enforceable rights depends on the treaty text and the steps required for it to become effective.
**It will sit alongside an existing ASEAN framework**
Both countries are already parties to the ASEAN Comprehensive Investment Agreement, which has been in force since 2012. A Cambodia–Myanmar bilateral pact could add a country-specific layer to that regional framework once it takes effect, but the relationship between the instruments will depend on the new treaty's wording.
Until that text is available, businesses have more reason to monitor the agreement than to restructure an investment around it. The details that will matter most are who qualifies as an investor, what assets are covered, whether earlier investments are included, when the treaty starts to apply and how disputes may be handled.
