Which Bali Listings Meet the Foreign-Buyer Price Threshold?

Published · Updated

What price floor applies to a Bali house or apartment?

The relevant number changes with the legal category of the home. Under Ministerial Decision ATR/BPN 1241/SK-HK.02/IX/2022, Bali has a minimum price of IDR 5,000,000,000 for a landed house (rumah tapak) and IDR 2,000,000,000 for a residential unit legally classified as a satuan rumah susun, or sarusun. The ATR/BPN legal register marked the decision Berlaku, meaning in force, when checked on 19 October 2026. It covers newly acquired and previously owned homes.

Government Regulation PP 18/2021, Articles 69–73, explains why a minimum asking price is only part of the assessment. A foreign individual needs qualifying immigration documentation and an ownership or use-right arrangement permitted for the particular kind of residential property. The regulation also identifies limits concerning land area, number of parcels or apartment units and residential use. Article 71 describes qualifying Hak Pakai structures for landed homes, and its treatment of apartment buildings depends on the underlying land right and the legally relevant location category. Accordingly, a five-billion-rupiah villa may still be unsuitable for the buyer and a two-billion-rupiah apartment may not even be a qualifying sarusun.

An agent can advertise an asking price, a starting price, a rounded figure or more than one transaction route for essentially the same space. Some of those numbers are for a lease and others are described as a transferable unit or land interest. Lease payments are not validated by comparing them to a home-purchase minimum.

The ministerial decision has a separate rule setting the price minimum for diaspora at 75% of the ordinary level. That would amount to IDR 3.75 billion for a qualifying landed home and IDR 1.5 billion for an apartment unit in Bali. It must not be treated as a general reduction for every foreign national: eligibility for that provision, including the buyer's documentary position, has to be established first. For a consistent reading, the six listings in this article are tested against the ordinary IDR 5 billion and IDR 2 billion benchmarks only.

Why the same asking price can describe different rights

“Freehold villa” and “foreign-owned villa” describe different things. In Indonesian land terminology, Hak Milik is a registered ownership right, commonly referred to in an advert as SHM or freehold. The listing may be describing the seller's current land title. It does not follow that a foreign national, known as WNA, can have that SHM registered in their own name. A property could be offered above IDR 5 billion with a genuine SHM held by the owner and still have no specified route for the proposed foreign purchase.

A foreign individual's potential rights to a landed residence are addressed in Article 71 of PP 18/2021. Hak Pakai is a legally distinct right of use, with possible structures depending on the underlying land title; the regulation also contemplates Hak Pakai on Hak Milik land through a right-granting agreement formalised in a PPAT deed. HGB, Hak Guna Bangunan, is another land right associated with the use and development of land and can be relevant to the land beneath an apartment building. Neither a seller's HGB nor a headline mentioning SHM establishes what a particular foreign buyer can register.

Leasehold creates a separate question. Hak Sewa or a 25-year lease concerns a contractual right to use premises for a stated term, subject to the actual agreement. It is not automatically a registered Hak Pakai and should not be evaluated as a freehold acquisition simply because an advert sits under a “for sale” heading. The Seminyak listing hos40075836 illustrates the distinction unusually well: the certificate field reads Hak Pakai, the descriptive text offers a “Leasehold villa 25 years”, and the asking price is IDR 6 billion. The number exceeds the landed-home floor by IDR 1 billion. The legal product being sold remains ambiguous.

Apartment terminology adds another layer. SHMSRS refers to a certificate for an individual condominium or apartment unit under the Indonesian rumah susun framework. A recognised unit right depends on the registered unit, the underlying land and applicable restrictions, including location and use. “Strata title” may be used by an agent as a sales phrase without giving the reader that documentary chain. In Berawa, aps7742563 advertises “Strata Title” while its certificate field says Lainnya, or “Other”. The Ramada Encore Seminyak advert aps7783763 names SHMSRS for one freehold-priced option but puts 20- and 30-year lease prices in the same description.

Older advice often assumes that an SHM house can simply be converted to a foreign buyer's preferred title at closing. The regulatory history is less straightforward. ATR/BPN's register records a partial 2025 repeal affecting provisions of Ministerial Regulation 18/2021; Regulation 2/2025 was itself repealed by Regulation 5/2025, which was later amended by Regulation 9/2025. Article 20 of Regulation 5/2025 describes conversion from Hak Milik to HGB through an auction or relinquishment followed by a new grant. None of this establishes an automatic SHM-to-Hak Pakai transfer for an advertised villa. The proposed deed and the current land-office procedure need individual review before the price can become the basis of a transaction.

Expectation and reality

Expectation

“Freehold” means a foreigner can take title

Reality

For hos40423896 and vls243285, SHM describes the apparent landowner’s title, not the foreign buyer’s registrable right.

TipObtain evidence of the current title and the specific right proposed for transfer.

Expectation

“Hak Pakai” field proves that this is the right transferred

Reality

The hos40075836 certificate box says Hak Pakai while the prose offers a 25-year lease; the actual legal interest is unresolved.

TipReconcile the certificate, holder and proposed agreement.

Expectation

“Strata Title” means the unit is WNA-eligible

Reality

The aps7742563 copy promises “Strata Title”, but the certificate field says “Other”; SHMSRS and land status are unverified.

TipRequest the individual unit title and the underlying land documentation.

Expectation

Above the price floor means legally eligible

Reality

An asking price above the IDR 5bn/2bn benchmark proves no buyer entitlement; PP 18/2021 imposes further conditions.

TipEstablish the legal asset category, transferable right and this buyer’s eligibility.

What the Badung listings actually say

Six Rumah123 listing IDs provide a dated look at the gap between advertised prices and legal eligibility in Badung Regency, as reviewed on 19 October 2026. Four adverts are categorised as houses or villas and two as apartments. On the portal's principal asking-price figure, two of the four houses are above the IDR 5 billion reference point and two are below it. Of the two advertised apartments, one is above IDR 2 billion and one below. That makes three above and three below the nominal floor for the advertised property type. It does not establish that six separately registered assets exist, are still on the market or could be acquired by a foreign individual. Listing-update dates are reported separately from the date of this comparison, and index snapshots may lag a seller's current instructions.

The two SHM-labelled villas sit on opposite sides of the landed-home line. Canggu listing hos40423896 has a headline price of IDR 4.4 billion, a shortfall of IDR 600 million, and mentions Pererenan in its sales copy. The same copy says “starting from” roughly IDR 3.99 billion and refers to units in a villa complex. There is no clearly identified individual registered parcel or unit connecting those figures. Pererenan listing vls243285, by contrast, quotes IDR 8.5 billion for a villa on 303 square metres of land and uses both SHM and “freehold”. Its price is IDR 3.5 billion above the threshold. What a seller holds and what a WNA buyer might receive remain distinct questions.

Seminyak's hos40075836 is advertised at IDR 6 billion, exactly IDR 1 billion above the landed-home benchmark. A price-only filter would place it in the higher group. Yet the certificate field states Hak Pakai and the description calls it a 25-year leasehold villa. The documents may reveal a coherent arrangement, but the advert supplies no basis for choosing one interpretation. Pererenan villa vls187429 is a different case. It appears in the portal's Canggu area and has an IDR 3.9 billion headline, IDR 1.1 billion below the purchase-price reference. The stated title is Hak Sewa, the body quotes USD 230,000 and specifies a lease term ending on 1 January 2049.

The apartment adverts are equally revealing without establishing registered apartment rights. Berawa listing aps7742563 asks IDR 3.39 billion in its summary and IDR 3,395,583,000 in the text. Either figure is about IDR 1.39 billion above the sarusun benchmark. The seller describes “Strata Title”, while the portal's certificate box reads Lainnya (“Other”). There is no displayed SHMSRS certificate or documentary confirmation of the land and building category. At Ramada Encore Seminyak, aps7783763 shows IDR 1.3 billion for a studio, about IDR 700 million under the apartment benchmark. Its description calls that the “SHMSRS Freehold” option and lists two separate 20- and 30-year leasehold prices.

Five certificate fields contain a more specific label: SHM twice, Hak Pakai, Hak Sewa and Strata once each. The Berawa field merely says “Other”, notwithstanding the more definite marketing language. One advert presents an unmistakable Hak Pakai/leasehold conflict, and the Canggu villa presents two different rupiah asking-price formulations. No official register extract or buyer-specific approval accompanies any of the six ads. The count is therefore useful for understanding prices and disclosure, not for estimating the proportion of Badung real estate open to foreign purchasers. Even the above-threshold group includes a disputed tenure description and a unit whose apartment status remains unverified.

Which listings remain unclassifiable for a foreign purchaser?

A reader can keep these examples straight by separating three findings: whether the displayed number is above or below a reference price, what tenure the advert actually claims, and whether that claim supports a transaction for a particular foreign buyer. Pererenan's IDR 8.5 billion SHM villa passes the arithmetic test while offering no documented foreign-buyer route. The IDR 4.4 billion Canggu villa misses the headline-price floor, but its possible future use by a foreign national cannot be categorically judged without knowing what right would be offered. Likewise, the IDR 3.9 billion villa labelled Hak Sewa is a lease case: the purchase-price floor was not designed to certify that contract.

Conflicting marketing language deserves scrutiny without treating it as proof of wrongdoing. The Hak Pakai box in hos40075836 might refer to an underlying registered right while the proposed commercial agreement is a lease; the advert does not supply evidence for that or any other reconciliation. It would be premature to accept either term as the confirmed object of a transfer. Berawa's aps7742563 has a different problem. “Strata Title” is asserted in its headline and body, yet the certificate field says “Other”. Condominium branding, a hotel building and an apartment classified in a property portal do not automatically share the same status under the Indonesian sarusun rules.

The hos40423896 headline says IDR 4.4 billion while the description advertises units from approximately IDR 3.99 billion. Both are below IDR 5 billion, so the direction of the comparison is stable; the actual price for a specifically identified villa is not. The Ramada Encore studio mentions SHMSRS freehold at roughly IDR 1.3 billion as well as two different paid lease terms. Those routes cannot be added together or counted as three registered apartments. The Pererenan lease listing also puts a US-dollar figure in its text. Without a dated conversion and a proposed contract, an exact comparison of that foreign-currency figure is unsupported.

What can be concluded is narrower, but more actionable, than an apparently precise legality score. For now the findings are “above the displayed price reference, tenure unverified”, “below the reference, separate lease route”, “advertised apartment, qualifying sarusun status unproven”, or “inconsistent rights descriptions”. None of these necessarily establishes an illegal offer. Documentary evidence, not the direction of a price difference, determines when a listing moves from an interesting lead to a transaction worth assessing.

What must be documented before a listing becomes a viable option?

Before commissioning a valuation or negotiating a deposit, the buyer needs a description of the exact legal interest being offered for the advertised price. With an SHM villa, the starting evidence is a current land-register record identifying the parcel, the holder and any relevant restrictions. The listed land area, building and seller should match what appears in the proposed transaction. If the description says “units from IDR 3.99 billion”, the agent also needs to identify which villa is priced at that amount. Otherwise a prospective buyer may be examining documents for a different parcel from the one they intended to reserve. Any proposed Hak Pakai arrangement must be shown as a genuine available legal route, not a routine paperwork switch promised on the strength of a freehold heading.

The IDR 6 billion Seminyak villa calls for a more specific first question: is the seller offering a transfer of a registered Hak Pakai, the creation of a new qualifying use right, or an assignment of a 25-year lease? Those may describe legally different parties, rights, durations and documentation. A certificate in one person's name does not necessarily prove authority to convey the contract being offered in the sales text. The draft agreement and certificate should tell the same coherent story, including who receives the money and what happens when the relevant term ends.

Apartment due diligence starts with the individual unit rather than the property portal's category. A unit number and 44 or 58 square metres are identifiers, not proof of an SHMSRS certificate. Evidence is needed that the premises are a legally recognised sarusun, that the registered rights to the building and its land support the proposed unit title, and that the conditions for this foreign buyer and this location can be met. This matters particularly when the listing is connected to a hotel or mixed-use scheme, where a studio offered for occupation may not be identical in law to a transferable residential unit. The Berawa “Strata Title / Other” discrepancy and the Ramada Encore freehold-versus-lease alternatives are questions about documents and contracts, not questions that an estate-agent description can conclusively answer.

The purchaser's circumstances must be brought into the analysis before anyone describes the transaction as available to a WNA. PP 18/2021 refers to qualifying immigration documents, and the broader conditions include residential use, category, number and area restrictions where applicable. The diaspora provision cannot be used without establishing that the buyer falls within its scope. A notary or PPAT should test the proposed documents against the current legislation and applicable BPN procedures, taking account of the 2025 changes to the administrative rules.

The practical endpoint is a proposed transaction that can be stated without euphemism: a named party grants or transfers a specifically identified right over a particular parcel or unit, for an agreed price and, where relevant, a specified term, to a buyer entitled to hold it. If that sentence cannot yet be supported, serious non-refundable payments would rest on assumptions. They are not a substitute for a land-office check or an assurance that registration will be approved; they are the material needed for a meaningful decision about whether to take negotiations further.

Questions the price comparison still leaves open

Is the same price floor used for all foreign purchasers?

The ordinary Bali references are IDR 5 billion for landed homes and IDR 2 billion for qualifying apartment units. The ministerial decision sets a separate 75% minimum for diaspora, equivalent to IDR 3.75 billion and IDR 1.5 billion respectively. That exception is not available merely because someone is a foreign passport holder. The buyer must establish eligibility and document it; the six listed prices have been compared with the ordinary floors.

Can a USD asking price be compared with the statutory IDR floor?

A conversion is useful for illustration only if its exchange rate and date are stated. The vls187429 advert, for example, shows IDR 3.9 billion in its header and USD 230,000 in the description of a lease expiring in 2049. A hypothetical conversion does not establish the final contractual price or the right being granted. The residential purchase-price threshold is not a legal test of the lease itself.

Does every apartment or condotel room qualify as a sarusun?

No. “Apartment”, “studio”, “strata” and “condotel” are marketing or property-category descriptions, not proof of an Indonesian registered residential unit. The buyer needs evidence of SHMSRS or another relevant registered status, underlying land rights, permitted use and applicable location restrictions under PP 18/2021. Hotel-associated and mixed-use accommodation can require particularly careful classification. Until those documents are available, the IDR 2 billion comparison remains conditional.

Bali expert view

Andrey Balinsky

In the IDR 6 billion Seminyak advert, the certificate field says Hak Pakai while the copy offers a 25-year lease. Those phrases do not establish the same transferable interest, however far the asking price sits above the landed-home minimum. The sensible order is to identify the registered holder and obtain the proposed contract before testing which statutory price rule, if any, applies. An expensive listing with an unresolved tenure description is still an unresolved transaction.
