Can a Specific Bali New Home Prove 2026 VAT Relief Eligibility?

Published · Updated

Which 2026 new-home sales can receive PPN DTP?

A Bali listing can call a newly marketed property a villa, display a “PPN DTP” banner and still leave the crucial tax question unanswered. Indonesia’s PMK 90/2025 covers a first supply of specified residential property: a landed dwelling (rumah tapak), including qualifying terraced or partly mixed-use residential buildings, or a residential apartment unit (satuan rumah susun). It does not grant VAT relief to every purchase labelled “new”. A resale, a leasehold arrangement, shares in a property-owning company or a stand-alone construction contract needs its own legal analysis; the word “villa” cannot put such transactions into the housing scheme.

The identity of the supplier is central. A qualifying home has to be sold on its first transfer by the developer that constructed it and is registered as a Pengusaha Kena Pajak (PKP), meaning a seller required to account for VAT. The property must be new, ready to occupy and not previously transferred. It also needs a kode identitas rumah, a house-specific identifier assigned through the designated housing system. A developer’s trading name, a map pin or the floor-plan label “Standard” cannot establish any of those facts. In particular, a group’s publicity does not establish which legal company will execute the sale or issue the tax invoice.

Two events must occur within the 2026 window. Between 1 January and 31 December, the parties must execute an AJB, the land sale deed prepared by an authorised land-deed official (PPAT), or a paid-in-full preliminary sale agreement (PPJB lunas) before a notary. There must also be an actual handover of a ready-to-occupy property evidenced by a signed BAST, the formal handover report, during that same period. A booking form, an unfinished building and a completion estimate are different things. The relief is available for one qualifying home per individual under the 2026 scheme; meeting the price test does not override that restriction.

The numbers often cause the biggest misunderstanding. The eligible sale price may not exceed IDR 5 billion, whereas the government-borne portion of VAT is calculated only on the first IDR 2 billion of that price. The latter is a portion of the selling price, not a cash grant. In the annexed PMK examples, the ordinary VAT computation uses 12% of 11/12 of the relevant amount. Applied to IDR 2 billion, that produces IDR 220 million of VAT covered by the government. A qualifying IDR 3 billion transaction under the same illustration could still leave IDR 110 million of VAT on its last IDR 1 billion for the buyer. Actual tax invoices, the tax base and the agreed price remain decisive for any real transaction.

There is an additional timing trap. An initial deposit or instalment paid before 1 January 2026 disqualifies the transaction from this version of the incentive even if the keys change hands later in 2026. The prescribed invoices, registration of the BAST and seller’s tax reporting also matter. A buyer comparing offers should therefore separate the advertised gross price, the price exclusive of VAT, the amount of any promotional rebate and the legally recorded sale price. None of these can safely be substituted for another when deciding whether a particular house qualifies.

What does “Free PPN 100%” really cover?

Expectation

“Every new home is entirely VAT-free”

Reality

The state covers VAT on only the first IDR 2bn, provided the home’s sale price does not exceed IDR 5bn.

TipVAT on the remainder may still be payable.

Expectation

“The incentive is an IDR 2bn discount”

Reality

IDR 2bn is the sale-price slice used to calculate eligible VAT; the PMK example produces IDR 220m.

TipDo not confuse the tax base with money paid by the state.

Expectation

“Kirana’s Free PPN must be state-funded”

Reality

Kirana’s June offer listed IDR 6.8bn excluding VAT, above the statutory sale-price ceiling.

TipThe offer may be commercial; its funding and contract terms need written confirmation.

Expectation

“A December delivery promise settles eligibility”

Reality

Eligibility requires an actual 2026 handover, a qualifying agreement, BAST and compliant tax records.

TipA construction forecast is not a signed handover record.

What do Bali listings actually show about the incentive?

The Links Jimbaran Residence and Ciputra Beach Resort offer a useful contrast because both have carried VAT-related promotions, but the advertising supports different conclusions. The material below reflects public pages reviewed on 19 October 2026. It should not be read as an October price list or an assertion that the May–June 2026 promotions remain available. “Standard”, “Hook”, “Svana Signature” and “Kirana” name marketed housing types across two developments, not four independently documented sales or four grants of state VAT assistance.

At The Links, the Standard listing identified as vls275982 was updated on 20 June. Its copy advertised approximately IDR 2.5983 billion alongside an incentive price of IDR 2.3783 billion. Another listing, vls276633, last updated on 23 May, gave the Hook type a higher reference price of about IDR 2.9046 billion and a promoted figure of IDR 2.6846 billion. Both pairs differ by IDR 220 million. That matches the full VAT relief in the regulation’s worked calculation for the first IDR 2 billion. The promotional copy also refers to “government-borne VAT of IDR 2bn”, potentially confusing the qualifying slice of the sale price with the VAT benefit itself. The IDR 220m difference is a useful clue, not evidence that either individual property has been assigned a government house code or received an eligible VAT invoice. A displayed discount may also sit alongside other commercial terms, which makes the contractual breakdown essential.

Timing and land-title descriptions add uncertainty at The Links. The ads talked about a December 2026 completion and handover, while one also described a six-month construction period running from receipt of the down payment. Those statements might have fitted a buyer who booked earlier in the year; they do not by themselves establish a feasible December handover for a purchase begun in October. Different listings describe the title as SHM or HGB. Because an agent may market different parcels and may use a shorthand label, the discrepancy should be resolved against the proposed lot’s documents, not “corrected” by choosing one advert. PT Bali Pecatu Graha is mentioned as the developer, but the identity and PKP registration of the company issuing the eventual invoice have not been established from these listings.

The Ciputra Beach Resort project page places its residential development in Kediri, Tabanan, with a range of house types. Svana Signature has a separate page, hos0100401, updated on 13 April 2026: it shows a type price near IDR 5 billion and a “Free PPN 100%” deal from IDR 4.7 billion marked as running through May. That information shows why “starting from” pricing is not enough for an incentive decision. The seller has to specify the actual home, the price excluding VAT, the promotional consideration and the legal supplier. The broader project’s stated April 2026 construction-completion date does not prove when a particular Svana home was handed over to its buyer.

Kirana provides a clearer price warning. The dedicated page hos3100000292, updated on 24 July 2026, repeats a June offer at IDR 6.8 billion excluding VAT, accompanied by “Free PPN 100%” and a payment schedule referring to an immediate unit handover after a 50% down payment. If that IDR 6.8 billion is also the actual sale price in the taxable first supply, it exceeds the IDR 5 billion ceiling and cannot qualify under PMK 90/2025. A developer could separately absorb VAT as a commercial concession; the promotion’s funding, invoice treatment and continued availability are not shown. The wording alone does not support an accusation of wrongdoing, nor does “immediate handover” establish a signed BAST.

The public evidence therefore stops short of a full approval for any of the advertised types. Standard and Hook look compatible with the statutory price threshold on the old figures; Svana sits at the boundary and needs a lot-specific contract price; Kirana’s published figure conflicts with the government price test. The sellers’ PKP credentials, house identity codes, prior-transfer history, handover records and invoice trail remain to be established for actual purchases. The distinction matters: undisclosed evidence is not the same thing as a failed requirement.

What evidence do the named Bali offers disclose?

Public-listing snapshot checked 19 Oct 2026. These are advertised house types in two projects, not verified transfers. “Not evidenced” means the public page does not establish the fact; Kirana has an additional advertised-price conflict with PMK.

Why is a promised December 2026 handover not enough?

A six-month build schedule and a December completion claim appear together in The Links advertising. They describe different things. The down payment (DP) can start the contractor’s timetable, but it neither completes the legal sale nor transfers a ready home to the buyer. If a contract signed in October starts an entirely new six-month build, its apparent completion date is outside 2026. A particular plot might already be substantially built or have a revised timetable; neither fact can be inferred from an earlier promotion. A new written handover plan is what would resolve the discrepancy for that home.

Under PMK 90/2025, a qualifying 2026 transfer has two distinct milestones. The parties sign either an AJB before an authorised land-deed official (PPAT) or a fully paid PPJB before a notary. They also physically transfer the right to use or occupy the finished home, evidenced by a BAST, the formal acceptance and handover record. Both belong within 1 January–31 December 2026. A reservation agreement and an estimated completion date cannot stand in for a BAST. This record must identify the VAT-registered seller, buyer, selling price, transfer date, house code, signed statement of completed handover and its own document number.

The initial payment date is a separate hurdle. Article 9 expressly excludes a transaction whose deposit or first instalment was paid before 1 January 2026, even if its handover falls in the new tax year. A 2026 deposit meets that one timing test but cannot rescue a house that is transferred in 2027. Kirana’s June promotion went further: it paired immediate handover after a 50% payment with 24 instalments for the balance. That advertised payment structure does not establish a paid-in-full notarised PPJB or AJB within 2026, or a signed BAST for any particular buyer. Before paying for unfinished construction, a buyer should be able to identify the plot, price, responsible seller, expected readiness date and the agreed handover procedure. A final signed BAST becomes available only once the property is actually delivered.

Some evidence necessarily follows handover. The seller-PKP must lodge the BAST in the authorised housing application by the end of the month following the transfer. A December 2026 handover therefore allows registration through 31 January 2027; that administrative extension does not move the deadline for the physical handover itself. The seller must also issue compliant Faktur Pajak VAT invoices: transaction code 07 for the first IDR 2 billion of eligible sale price and code 04 for any portion above that amount, together with the house identity and prescribed relief wording. Its VAT returns serve as the PPN DTP realisation report, with the special reporting deadline for 2026 returns falling on 31 January 2027 under Article 8(9).

Missing registration, incorrect invoices or omitted reporting can cause the government-borne VAT treatment to fail even where a project was completed on schedule. That risk belongs in the transaction’s economics: if a buyer negotiated a discounted price on the assumption of relief, the agreement should make clear what happens if the qualifying handover does not occur by year-end. A promotional headline alone says nothing about whether the seller will honour the quoted total, absorb additional VAT or seek payment from the buyer. There is no automatic personal payout from the government to make up for a missed deadline.

Can a foreign buyer claim the 2026 relief on a Bali home?

Foreign citizenship is not, by itself, a prohibition on receiving the 2026 government-borne VAT incentive. Article 6 expressly includes a foreign individual (WNA) who holds an Indonesian taxpayer identification number (NPWP), provided that the person’s acquisition of the home complies with the country’s foreign residential ownership rules. That proviso is substantive. An NPWP establishes a tax identifier, not ownership rights to a particular Bali villa. A buyer must pass both the tax test for the first supply and the land-law test for the property interest being transferred.

The ATR/BPN legal record for Ministerial Decision 1241/SK-HK.02/IX/2022 was marked “Berlaku”, or in force, when reviewed on 19 October 2026. In a publicly recorded explanation, Bali’s land-office leadership described minimum residential acquisition prices under the relevant foreign-buyer framework: IDR 5 billion for a landed house and IDR 2 billion for an apartment unit. These figures are not universal minimum prices for every long-term lease, company-share deal or resort investment contract. They concern the acquisition routes governed by those rules. The precise title permitted to the buyer and any subsequent changes to the framework still require a transaction-specific review.

This produces a narrow issue for landed homes. PMK 90/2025 caps the eligible selling price at IDR 5 billion, while the cited foreign-acquisition route has a landed-home minimum of IDR 5 billion. On those assumptions, the two limits meet at exactly IDR 5 billion. Yet even a house quoted at that number is not automatically an eligible foreign purchase. PMK uses the defined sale price, excluding VAT; a listing might display VAT-inclusive asking prices, a promotional “from” figure or a price for a housing type rather than the plot the buyer will acquire. The older Svana Signature promotion from IDR 4.7 billion illustrates why satisfying a domestic VAT price ceiling does not establish a foreign buyer’s entitlement to a landed title.

A residential apartment has a different intersection of rules. The cited IDR 2 billion foreign-acquisition minimum and the IDR 5 billion government-incentive maximum do not collapse to the same point. That does not mean any Bali apartment between those figures qualifies. It must be a qualifying residential strata unit with a legally available ownership interest, a first handover from the VAT-registered builder and the required home-code, handover and invoicing documents. A hotel room marketed as an apartment, a lease of a serviced villa and equity in a company should not be treated as equivalent without analysing the actual contract.

Land-title labels in the listings are another warning against assumptions. The Links ads variously describe SHM and HGB; the property-specific legal evidence is needed to resolve what the seller can transfer. An ordinary foreign individual cannot take Indonesian SHM ownership merely because a listing calls a villa “freehold”. The Bali land-office explanation describes qualifying foreign interests through hak pakai, or legally recognised rights of use, under the relevant rules. A local independent PPAT or qualified land-law professional should examine the buyer’s status, the underlying certificate, the intended registered right and the signed sale price alongside the seller’s tax documents. Until those facts align, a projected PPN DTP saving is an unverified assumption, not part of a dependable purchase budget.

Further questions about 2026 PPN DTP

Can I use the 2026 incentive after claiming PPN DTP in an earlier year?

Earlier claims do not automatically bar a new eligible purchase. Article 5(2) permits an individual to claim under the 2026 regulation for a different qualifying home, provided the remaining conditions are satisfied. The 2026 one-unit-per-person limit still applies. Cancelling a pre-2026 purchase and re-buying the same unit does not create fresh eligibility under Article 5(3).

What happens if the buyer transfers the home within one year of handover?

A transfer within one year of handover is an express disqualifying condition in Article 9(1)(e). Article 10 allows the tax authority to recover VAT when the requirements were not met. The relevant clock starts with the actual handover, not the listing date. How the resulting cost is allocated between parties also depends on the contractual and tax records.

Can the 2026 scheme be stacked with another VAT exemption on the same home?

Article 11 rules out PPN DTP for a home that has already received a separate statutory VAT exemption. A seller-funded price concession is a different question and may be governed by the contract rather than the government scheme. The phrase “Free PPN” does not reveal which mechanism applies. The promotional conditions and tax invoices have to show what, if anything, is being combined.

Bali expert view

Andrey Balinsky

Kirana’s advertised IDR 6.8 billion asking price sits above the government incentive ceiling, despite its “Free PPN 100%” promotion. Those two statements can coexist if the seller is offering a separate commercial concession. The advertisement does not identify that mechanism or establish a state-funded benefit. At The Links, a repeated IDR 220 million price difference happens to match the regulation’s worked VAT example. That numerical match still leaves the contracting PKP, individual house identifier and actual handover date unresolved. A buyer’s financial plan should follow the agreement and the tax evidence, not the headline on a listing.
