How Should You Read a Bali Notary and PPAT Fee Quote?

Published · Updated

Why a single closing fee hides separate payees

A Bali closing quote can be short enough to fit in a message: “notary and PPAT — 1%,” followed by a request for an advance. That is not yet a usable breakdown. The office collecting the money may be doing several jobs and may also be passing money on to a land office or a tax authority. A buyer needs to know which part compensates a professional, which part is a statutory charge, and which part is held pending payment to someone else. A single percentage answers none of those questions.

For a qualifying sale of a registered land right, the critical instrument is usually the akta jual beli (AJB), executed before a Pejabat Pembuat Akta Tanah, or PPAT. The PPAT is an official authorised to draw up particular land deeds. A notaris has a distinct legal office and may execute other instruments required by the transaction. Indonesian rules permit one person to hold both appointments, so a firm's sign may use both titles. The two capacities remain separate. If a quotation includes a notarial fee as well as an AJB fee, the buyer should be able to identify the additional deed, its purpose, the capacity in which it will be signed and the work charged for it.

The property being marketed as a “villa” does not settle the legal instrument. A private long lease, a preliminary sale agreement known as a PPJB, a company-formation engagement and a completed transfer of a registered title may involve entirely different documents. Nor does a fee quotation establish that the proposed buyer is legally eligible to hold the relevant right. In particular, a foreign individual should not infer an entitlement to Hak Milik from an agent's description of a freehold villa. The underlying rights structure must be checked independently before anyone assumes an AJB closing applies.

Badung Regency and Denpasar City offer a useful geographic comparison, provided the underlying transaction is held constant. The statutory PPAT fee bands are national, so one district has no separate statutory PPAT percentage of its own. However, the location of the registered parcel determines the relevant land-registration office, while the person executing the deed must have territorial authority. PP No. 24/2016 establishes a provincial work area for an ordinary PPAT; the office's street address and the officer's legal authority should not be confused. When comparing written quotations, use the same type of right, intended deed, deed consideration, requested searches, language requirements and allocation of closing costs.

One more distinction keeps the whole exercise honest: collecting money is not the same as being entitled to it. An office may take funds to settle land-registry PNBP or taxes, but it should be able to distinguish those transfers from its own charges and explain the supporting receipt. The registered transfer, associated search, professional advice and tax settlement may happen around the same closing date without becoming one legally regulated service. The itemisation is therefore as important as the headline total.

What the law actually allows a PPAT to charge

The starting rule is article 32 of Government Regulation 37/1998 as amended by Government Regulation 24/2016. It sets an overall ceiling of 1% of the transaction price recorded in the deed for a PPAT's deed work, inclusive of witness honoraria. “Not exceeding 1%” should never be read as a compulsory charge of 1%. It is a limit on a defined official function, not a nationwide closing-cost package and certainly not a tax payable to the PPAT.

Ministerial Regulation ATR/BPN No. 33 of 2021 makes that ceiling more specific. Under article 1, the applicable maxima are: 1% for a deed price of up to Rp500 million; 0.75% when the price exceeds Rp500 million but does not exceed Rp1 billion; 0.5% above Rp1 billion through Rp2.5 billion; and 0.25% for a price above Rp2.5 billion. Each band applies to the entire consideration stated in the individual deed. These are not marginal income-tax brackets, and there is no exercise of charging 1% on the first Rp500 million and adding successive bands. An office can agree a lower fee, subject to the applicable rules.

Take an illustrative AJB stating a consideration of Rp1.6 billion. It falls into the 0.5% band, making Rp8 million the maximum PPAT deed honorarium under this rule, including witnesses. That number is a calculation of a legal cap, not a quotation obtained from a Bali office, an estimate of a typical fee, or a total closing budget. Calling the same Rp16 million line “PPAT 1%” would be inconsistent with the tiered deed-fee limit if it really compensates the PPAT for that deed alone. If the office says the line covers several other services, the analysis becomes one of scope and evidence: what services, how much for each, and on what basis?

The witness point is important because the regulation expressly includes witness honoraria within the PPAT fee. A separate witness invoice added on top of a full deed fee is therefore a question to resolve, not a second automatic statutory entitlement. Article 32(3) of the amended PPAT regulation also prohibits extra collections in the discharge of the PPAT's regulated duties, while article 3 of the 2021 ministerial regulation addresses administrative sanctions for overcharging. A new label such as “document preparation” cannot by itself turn work inherent in the official deed function into an independent billable service. Conversely, a genuinely separate engagement should not be condemned merely because it appears on the same office's letterhead. The distinction requires an identifiable deliverable and the legal or contractual basis for charging it.

The notary's role follows different legislation. Article 36 of the Notary Office Law, Law 30/2004 as subsequently amended, establishes a distinct framework for remuneration for notarial legal services. If the parties actually need a separate notarial instrument, such as a properly scoped PPJB, the quote should identify that instrument and its fee independently of the PPAT's AJB. A title search, a meeting with the buyer and a lawyer's review are not automatically additional notarial deeds. Nor does holding a dual PPAT/notaris appointment entitle a professional to charge two deed fees for one deed.

Apply the percentages only after establishing the actual deed and its stated price. Then examine everything outside that calculation without assuming that either the total package or each added item is necessarily lawful. Taxes, BPN service charges and properly commissioned ancillary work can push total disbursements above a PPAT cap without changing that cap. Equally, an “all-in” fee may disguise an excessive regulated component when the other services have no defensible separate scope. The official instruments and their registry status were checked as at 19 October 2026; any live closing should be assessed against the rules in force for the relevant deed and service at the time it is executed.

What a genuine itemised Bali quote can establish

A line reading biaya balik nama is a good test of a quote's usefulness. In ordinary speech it may refer to “changing the name” on a title, yet the invoice might be bundling deed preparation, the registry application, government charges or office assistance. Those are different services and payees. A website advertising a percentage cannot resolve the ambiguity. A genuine written engagement for a specified transfer can, provided it states what the office is undertaking and which disbursements are outside its professional fee.

The minimum usable record is a dated quotation attributable to a real office, identifying the professional capacity of the signatory, the type of registered land right, the intended instrument and the parties' agreed transaction specification. The proposed consideration in an AJB matters because the 2021 PPAT ceiling is determined by the price stated in each deed. The relevant parcel and service type matter for land-registry charges. A search described simply as “certificate verification” might be a basic official inquiry, a substantive legal investigation, or both; those outcomes are not interchangeable. The document should also distinguish the party legally liable for a tax from the party instructed to advance it at closing.

A meaningful Badung–Denpasar comparison would hold the work constant. Imagine, purely as different *possible scopes*, one office being asked only to prepare and execute the AJB while the buyer arranges taxes and registration payments separately. Another instruction might include the title search, BPN submission, a translation and an additional deed. A higher combined figure for the second scope would tell us nothing about a local difference in statutory PPAT fees. Likewise, a cheaper headline quote may simply omit tasks that appear later as extras. Only a line-by-line reconciliation of written deliverables and exclusions makes the offers comparable.

No original, dated, transaction-specific PPAT quotation from Badung or Denpasar with a verified basis for editorial anonymisation was available for this review as at 19 October 2026. Public cost calculators and agency fee illustrations are not closing instructions issued by the PPAT for a specified transfer. Older private documents with identifiable parties and payment details cannot responsibly be republished or treated as 2026 market evidence. As a result, this page does not present fictional Quote A and Quote B, an average Bali bill, or supposedly observed office prices. The adjacent classification of line items explains legal categories; it does not claim to reproduce a bill obtained from a practice.

A real quote, when obtained, would prove the terms offered by one issuer on one date and for one case. It would not establish that a land-registry payment had reached the government or that the certificate had been successfully transferred. An official payment reference, receipt and later registry record would be needed for those separate propositions. Nor would one paid invoice establish a representative market rate. This evidence limit is decisive for publication: the regulatory explanation can be prepared now, but a page promising a breakdown of an actual commercial quotation needs an attributable, publishable original before that claim can be made.

Why a land-registry charge is not a PPAT fee

PNBP means penerimaan negara bukan pajak, or non-tax government revenue. A BPN land-registry service can attract PNBP independently of what the professional office charges for drawing up a deed or assembling an application. The office may collect money as an agent for payment, but that does not make the government charge part of its earned honorarium. An invoice should therefore show the official service being purchased and the expected payment reference, rather than presenting the whole sum as a “notary fee.”

For the specific land-right transfer registration service covered by article 16(2) of Government Regulation 128/2015, the formula is T = (1‰ × Nilai Tanah) + Rp50,000. The per-mille factor is 0.1%, but the relevant base is *Nilai Tanah*, not the consideration typed into the AJB by default. The regulation's explanation refers to the land value established through an approved land-value zone map, or ZNT, for the relevant year, with the land component of the applicable NJOP used where that zone value is unavailable. A beachfront villa's asking price may include buildings and other assets, while this PNBP formula uses the prescribed land value. It cannot be applied accurately without the parcel area and official valuation basis.

This service is easily confused with other activities also performed by ATR/BPN. First-time rights registration or an extension decision, for example, is not the same service as recording a subsequent transfer; article 16(1) deals with a different event and formula. A certificate search has its own category. The appendix to Regulation 128/2015 lists pengecekan sertipikat at Rp50,000 per certificate in that instrument, but the correct tariff still needs to be verified for the current request, delivery channel and any later rules. An office's separate fee for investigating the chain of title, encumbrances or incomplete supporting records is a professional service with its own scope, not a second government search charge. Paying for an official certificate search also does not amount to a guarantee of good title.

Evidence of a genuine government charge should connect the particular service to its payment and recipient. A request ID, government payment reference or receipt is much stronger support than a line reading “BPN administration.” If staff are separately instructed to attend the registry, organise documents or deal with a rejected application, their proposed charge needs contractual wording and an identifiable deliverable. The arrangement can be legitimate; describing it as compulsory PNBP without an official basis cannot be. A useful quote separates the government's charge from the professional work of making the payment or filing the request.

Transfer taxes require their own columns. BPHTB is a local acquisition-duty obligation ordinarily borne as a matter of tax law by the person acquiring the right; the final PPh on income from a transfer ordinarily concerns the person receiving income from the disposal. These are not components of the PPAT fee or of BPN's PNBP. A sale contract may allocate the financial burden differently or ask the office to remit funds on a party's behalf without changing who the law regards as the taxpayer. Local BPHTB rules in Badung and Denpasar, reliefs and the precise taxable event must be assessed on the facts; no universal Bali tax computation can be inferred from a fee estimate. Supporting tax payment records should identify the actual obligation and payer.

Questions that make quotes comparable

Instruments and authority
  • Which registered right is transferring, what deeds will be executed, and what price will appear in each deed?
  • Who will execute the AJB as the PPAT, and does their current territorial authority cover this parcel?
  • What is the PPAT deed honorarium alone, and which 2021 statutory price band was used?
  • Are witness honoraria included within the PPAT fee, with no duplicate charge?
Scope and government charges
  • If there is a notarial fee, which separate deed does it pay for, and why does our transaction need it?
  • Which title searches and legal reviews are included, and which sums are BPN PNBP backed by official receipts?
  • Are BPHTB, PPh, any applicable VAT, translation, repeat attendance and corrections included or excluded?
Payment, deposits and evidence
  • Who is the statutory taxpayer, who will remit each payment, to which payee, and what proof will we receive?
  • When does the quote expire, who approves extras, and what happens to the deposit if the signing does not proceed?

What an all-inclusive percentage may leave out

“All inclusive” is a description of a sales offer, not a legal definition of the closing work. A quoted percentage may cover the AJB only, several professional services, or an amount from which the office plans to pay third parties. It may exclude taxes altogether. The phrase gives no reliable answer about certificate searches, BPN registration, translations, additional deeds or unforeseen corrections. Those matters depend on the engagement and any exclusions attached to it, not the size of the headline percentage.

The distinction between signing the AJB and completing the registration deserves particular attention. Execution of the relevant deed is one event; updating the registered ownership or rights record through the competent BPN office is another. A practice may agree to manage both, or leave the application and government charges to the client. Even when a quote says “balik nama included,” the wording might refer only to preparation and submission, with statutory PNBP payable separately. The buyer should know what tangible end point is promised, who will handle it, and what evidence will show completion. A district name in the address does not convert office assistance into a distinct Badung or Denpasar government tariff.

Conditional extras can be more disruptive than the original fee. A mismatch between the seller's identity documents and the registered certificate may require further work; an absent party may need a valid power of attorney; a new translation or corrected instrument may be necessary. Whether those tasks justify a separate charge turns on what was commissioned and what the fee legally covers. Repetition of work already inherent in a PPAT deed cannot simply be relabelled as a new service to evade the cap. For genuinely new work, a sensible engagement sets an approval procedure and explains how the price changes before the work starts.

The handling of advances matters just as much. If a signing is postponed or cancelled, the buyer needs to know which elements of an advance are refundable, whether any third-party charges have already been paid and what records will establish that fact. The seller's final PPh, the buyer's BPHTB and any applicable VAT on services should be distinguished from the office's professional charges and from one another. VAT should appear only where the relevant tax treatment and supplier status support it. The same caution applies to courier expenses, bank fees, repeat attendance and document corrections: an item can be real without being universal, and a stated price is not proof it has already been incurred.

A complete quote ultimately promises verifiable outcomes, not just a discounted percentage. It should identify the deeds to be executed, the searches or registration filings to be performed, the disbursements to official bodies and the receipts or outputs delivered afterwards. The risk is not confined to an expensive invoice. A low total with vague inclusions may leave the buyer funding an unexpected second stage, while a larger fixed package may be defensible if its distinct components are transparent and lawful. Until the money trail and scope of work are written down, comparing quoted totals gives a misleading impression of precision.

Bali expert view

Andrey Balinsky

A persuasive closing quote is not the one with the neatest percentage: it is the one that identifies the deed, each lawful payee and the evidence a buyer will receive. Conflating a PPAT's regulated honorarium with a BPN payment can conceal a pricing problem even when the total looks competitive, while legitimate separate services deserve a clear scope rather than suspicion by default. Price negotiations should begin after that separation has been made, not before the buyer understands what is actually being purchased.
