Property defects and warranties in Bali
The word “warranty” is useful only when it can be unpacked into a specific defect, responsible party, notice method, response window and evidence of completion. Everything else is expectation, not protection.
What should be checked before handover?
Do not try to predict every future problem. Build a verifiable starting point: what you inspected, which defects were observed, what is promised to be remedied, who confirmed it and how completion will be evidenced.
The short answer
A general legal framework does not replace a defect schedule and contractual remedy process. Before handover, ask for one list: location, description, photo or video, date recorded, responsible party, next step and what will count as a remedy.
Evidence scope
- Checked on
- 2026-10-15
- Established
- General consumer-protection and construction-services frameworks exist.
- Not established
- Warranty, defect, technical cause, duty or timing for a specific asset.
Record it while the defect is in front of you
“Fix the bathroom” disappears in a message thread. Far more useful: room, exact point, what is visible, when it was noticed, how it was recorded and what you are asking. Do not name a technical cause unless a relevant professional has confirmed it.
A warranty is a route, not a label
Check whether the agreement or a separate document states scope, exclusions, who receives notice, how receipt is evidenced, what response is expected and how remedy is recorded. Indonesia’s general consumer and construction-services framework matters, but it does not fill in those transaction-specific points for the parties.
- Law No. 8 of 1999 on Consumer Protection
- Law No. 2 of 2017 on Construction Services
- Law No. 2 of 2017 official text
Do not trade evidence for a promise
If a remedy is promised after handover, keep the defect on the open list. Each item needs an owner, access method, next review date and a simple criterion: what exactly you will see when work is complete. “We usually fix everything” is not a substitute.
Decision steps
- Step 1
Record only what is observable: location, photo and date.
- Step 2
Separate defects, unfinished works and questions for a specialist.
- Step 3
Match the item to the agreement or written promise.
- Step 4
Name the responsible party and notice channel.
- Step 5
Verify the result against a criterion agreed in advance.
